Ohio - The Ohio Supreme Court has overturned the death-penalty sentence of an Akron man because he is mentally retarded and cannot be executed.
By a 7-0 decision, the court sent the case of Clifton White III back to the Summit County Court of Common Pleas for re-sentencing as a non-capital case.
The decision, written by Justice Robert R. Cupp, said the common pleas court erred by disregarding objective results from two psychologists who examined White. Instead, the court based its conclusion on “anecdotal testimony” from a witness and the judge's own opinions. More...
